‘Shots fired’ dispatch results in drug charges

WELLSBORO - Justin H. Plank, 26, of 458 Main St., Antrim, was charged by borough police with disorderly conduct, fighting and possession of drug paraphernalia after police initially were dispatched to 130 E. Ave. for a report of shots fired in a residence.

According to documents filed at District Judge Rob Repard's office, on Nov. 30 the complainants said there had been a domestic incident and things got bad after what sounded like a single gun shot.

Police said they saw Plank sitting on a bed wearing no shirt. A second person in the apartment, Shawna Lathan, was wearing only a towel.

The two said they had been arguing and when asked about the gun shot, Plank said he didn't own any guns, but when he slammed a bathroom door it made a loud banging sound.

As police searched the residence for firearms, Plank said he didn't want them to look in his dresser drawers, but Lathan said he had nothing to hide.

When he opened the drawers, police saw two marijuana pipes, which Plank admitted were his.

He also was asked about a large scratch on his neck, which he said came from a cat, but a 14-year-old witness walking by the apartment said she saw him carry a naked woman, Lathan, outside and set her down and she was screaming for help, so the girl called her mother from her cellphone.

At that point Plank came back outside, picked Lathan up and took her back inside, when the screaming and a loud bang was heard, police said.

The two denied being in a physical altercation even after being confronted with evidence in the matter. Plank was issued a summons to appear at a Feb. 26 preliminary hearing.
