Police: Man charged after attacking woman, falling asleep, letting her go

WELLSBORO - Scott D. Slaby, 41, of 1437 Route 6, Gaines, was charged recently by state police with terroristic threats, unlawful restraint, simple assault, indecent assault and harassment after he allegedly attacked a woman at his residence.

According to documents filed at District Judge Rob Repard's office, Slaby and Jennifer M. Phelps arrived at his residence Oct. 26, where he allegedly threw her on the ground shortly after arrival.

He then climbed on top of her and put his hands around her throat and choked her, telling her to stop trying to leave because if she tried to run, he would kill her, police said.

He forcibly took her inside and told her to remove her clothes, but she told him she was not going to have sex with him, police said. He shoved her to the floor and started to remove her pants, then stopped and choked her again, police said, adding that she was forced to lay next to Slaby on a mattress where he fell asleep.

When he woke up, he gave her keys and cellphone back to her if she swore she would not press charges, police said.

Slaby was jailed in lieu of $15,000 bail and his preliminary hearing set for Tuesday.
