James Edward Sherwood, 52, of Cogan Station, expected to be sentenced for driving under the influence of intoxicants Wednesday in Lycoming County Court for an arrest made last June.
He was, but for the second time before Judge Marc F. Lovecchio, Sherwood showed up at his sentencing legally intoxicated.
Asked if he drank anything before his sentencing, Sherwood told Lovecchio that he consumed one beer. The judge immediately stopped proceedings and asked adult probation staff to administer a breathalyzer on the man, who recorded a .256 - more than three times the legal limit.
Sherwood's sentencing was continued to Aug. 9. His bail was immediately revoked, and he was ordered to the Lycoming County Prison.
